This Privacy Policy explains how Flexe, Inc. (“Flexe”, “we” or “us”) collects, uses, and discloses personal information about our customers, prospective customers, and website visitors (each, referred to as “you”). We are a business-to-business (B2B) company, meaning our customers are businesses and not individual consumers. We act as a service provider/processor to our customers – we do not have control over the personal information we receive from our customers about their individual consumers, which we process solely on our customer’s behalf for purposes of providing logistics services. We are not responsible for the privacy practices of our customers and recommend you check with them for more information about the policies they have in place.
This Privacy Policy is incorporated into and forms a part of the Terms of Service, together with all other terms and policies linked or otherwise referenced within the Terms of Service (available at https://www.flexe.com/terms-of-service. Capitalized terms used and not otherwise defined herein shall have the meanings provided in the Terms of Service.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy. We encourage you to review the Privacy Policy whenever you access or use our websites, applications, platform and other online products and services provided by us or on our behalf that link to this Privacy Policy (collectively, the “Services”) or otherwise interact with us to stay informed about our information practices and the choices available to you.
By visiting or using the Services, or by checking a box to indicate your consent to this Privacy Policy on our website, you are expressly accepting and consenting to the practices described in this Privacy Policy, including without limitation the deployment of cookies, pixels, and similar third-party tracking technologies for the purposes described herein. Further, you acknowledge and confirm that you have permission to provide us with all personal information that we process in connection with your use of the Services. If you have any objections to the Privacy Policy, you should immediately discontinue use of the Services.
What This Privacy Policy Covers #
As used in this Privacy Policy, “personal information” means information that can be used to identify an individual (directly or indirectly). “Personal information” may include, but is not limited to, your first and last name, your unique user ID, email address, and other information about yourself that you choose to submit through our Services. The term “personal information” does not include:
- aggregate or de-identified information that is not linked with your other personal information.
- Information collected in connection with recruitment, employment, or other job-related matters for partners, principals, employees, directors, officers, interns, and individuals engaged with Flexe through a third party, including contractors and contingent workers; such information is subject to Flexe’s internal policies, the Flexe Personnel Privacy Policy, and the Flexe Recruiting Privacy Policy; and
- Information collected by third parties who may reference or link to or may be accessible from the Services.

As of the “Last Updated” date indicated on this page, Flexe is subject to the data privacy laws of California, New Jersey, Maryland, and Texas (“Applicable States”). The data privacy laws in these states afford residents of those states with certain rights with respect to their personal information. We provide the information in this Privacy Policy to comply with the laws of the Applicable States.
Below is a summary of the categories of personal information that we have collected and how we have used that information in the twelve months preceding the date on which this Privacy Policy was last revised. Applicable state privacy laws require that we notify you if we use your personal information for “targeted advertising”; this includes the California Consumer Privacy Act, which requires that we provide transparency about personal information we “sell” or “share.” As used herein, “sale” means a transaction in which we disclose personal information of a resident of an applicable state to third parties in exchange for valuable consideration. “Targeted advertising” or “sharing” means selecting advertisements based on personal information obtained from activities of a consumer subject to applicable state privacy laws across unaffiliated websites to display certain advertisements to that consumer.
While we do not disclose information to third parties in exchange for monetary compensation, we disclose identifiers and Internet and network activity information to third party advertising networks and analytics providers for purposes of marketing and advertising, and to improve and measure our ad campaigns. Such disclosures may be considered a “sale” or “sharing” of Information under applicable laws. Collection of Personal Information #
Personal Information You Provide to Us
We collect information you provide directly to us. For example, we collect information when you access or use our Services, create an account with us, send us an email, fill out a form, communicate with us via third party social media sites, request customer support, or otherwise communicate with us. The types of information we collect includes your name, email address, postal address, phone number, employer, and any other information you choose to provide.
Information that is Automatically Collected When You Use the Services
When you access or use our Services or transact business with us, we automatically collect information about you, including:
Transactional Information: We collect information about your reservations and shipments, such as date and time of the reservation, product details, and packing, shipping and delivery status.
Log Information: We collect information related to your access to and use of the Services, including the type of browser you use, app version, access times and duration, pages viewed, your IP address, and the page you visited before navigating to our Services.
Device Information: We collect information about the device you use to access our Services, including the hardware model, operating system and version, and unique device identifiers.
Information Collected by Cookies and Similar Tracking Technologies
When you access and use our Services, we (and our advertisers and ad networks providing services to us) may use various activity tracking technologies, such as web beacons, pixels, cookies and similar tracking technologies, to collect information about your use of our Services, our emails, or our ad content. We (and our service providers) use different technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us customize and improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that may be used in our Services or emails and help deliver cookies, count visits, and understand usage and campaign effectiveness.
You can control the use of cookies at the individual device or browser level. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.
Personal Information We Collect from Other Sources
We may also obtain information about you from other sources. For example, we may collect your name and contact information from lead generation providers. We may also collect information about you from identity verification services, credit bureaus, mailing list providers, and publicly available sources. These companies may collect and use your personal information to help us reach you with our advertisements on our Services and on other websites across the Internet.

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your location based on your IP address.
Use of Personal Information #
We use the personal information we collect to administer your account and to customize your experience with us. We also use the personal information we collect to:

- send you technical notices, updates, security alerts, and support and administrative messages and to respond to your comments, questions, and customer service requests;
- communicate with you about products, services, and events offered by Flexe and others and provide news and information we think will be of interest to;
- monitor and analyze trends, usage, and activities in connection with our Services;
- personalize your online experience, display advertisements that are targeted to your interests, and audit your interactions with our online ads, including by counting ad impressions and verifying positioning and quality of ad impressions;
- detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and protect the rights and property of Flexe and others;
- debug to identify and repair errors that impair existing intended functionality;
- for limited internal uses, provided the personal information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside the current interaction;
- in connection with research and development activities; and
- carry out any other purpose described to you at the time the information was collected.
We also may share your personal information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Flexe, the Services, our users, or others; to prevent and protect Flexe and its users from fraudulent, abusive, unlawful, or unauthorized use of the Services; to otherwise enforce our rights and agreements; and otherwise in connection with our Terms of Service and other agreements with you, in each case as permitted by applicable laws. In such cases, we reserve the right to raise or waive any legal objection or right available to us at our discretion.
Note that we do not process, use, or disclose any sensitive personal information (such as social security or passport number, financial account information, racial or ethnic origin, and biometric information) unless it is specifically submitted by you. To the extent that you submit any sensitive personal information, our use of such information will be limited to that use which is necessary to provide our Services to you and/or for the uses to which you have consented. We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Privacy Policy. We will delete personal information in accordance with our standard document retention schedules.
Sharing of Personal Information #
We share personal information in the following circumstances:
- with advertising partners to serve you third-party advertisements, including interest-based advertisements, on our Services and on other services. Specifically, we share information collected through cookies and similar technologies with our advertising partners, which may also be subject to their privacy policies. - with vendors, service providers, and consultants that perform services for us, including service providers that assist us with customer relationship management, payment processing, website hosting, or data analytics;
- in response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
- if we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of Flexe or others;
- in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company; and
- with your consent or at your direction.
When we transfer personal information to third parties, including service providers and business partners, certain data privacy laws require that we ensure that those third parties protect that personal information in a manner consistent with our privacy policies and applicable data protection laws. As such, we enter into agreements with these third parties to ensure they adhere to the same data protection principles and obligations that apply to Flexe where required.
Retention of Personal Information #
We reserve the right to retain personal information collected about you for as long as necessary to fulfill the purpose(s) for which it was collected, such as to enable or improve your access to or use of the Services, and otherwise as necessary to comply with applicable laws and our legal obligations (including business, legal, or tax purposes), resolve disputes with any parties, and otherwise as needed to provide the Services that you have requested. We strive to destroy personal information once it is no longer necessary in accordance with applicable laws.
Data Security #
Flexe takes reasonable administrative, technical, and physical precautions to protect our users' personal information from accidental or unlawful destruction, loss, theft, copying, or unauthorized disclosure, access, use, or modification. We protect our users' personal information using industry-standard SSL encryption. Unfortunately, however, no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its security.
Advertising and Analytics Services Provided by Others #
We may allow others to provide analytics services and serve advertisements on our behalf across the web and in mobile applications. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. This information may be used by Flexe and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity.
We may also work with third parties to serve ads to you as part of a customized campaign on third-party platforms (such as Facebook or Instagram). As part of these ad campaigns, we or third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and to serve you advertising that is customized to your interests. Our use of online tracking technologies, and use of such technologies by our advertising and marketing partners, may be considered a “sale” or “sharing” under certain state privacy laws. To the extent that disclosing information to these online tracking technologies is deemed to be a “sale” or “sharing” under certain laws, you can opt out of these online technologies by submitting a request using the process described in the “Submitting your Requests” section below. Please note that some of the features of our Services may not be available to you as a result of these choices. Additionally, note that the third-party platforms may offer you choices about whether you see these types of customized ads.
Transfer of Personal Information #
Flexe is based in the United States and we process and store personal information in the U.S. and other jurisdictions. Therefore, we and our service providers may transfer your personal information to, or store or process it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. Where we transfer personal information to the U.S. or other jurisdictions in relation to providing our Services, we use approved safeguards for such transfers when required by the law of the originating country, and otherwise make commercially reasonable steps designed to ensure that the personal information is treated securely and in accordance with this Privacy Policy. Unless data privacy laws require otherwise, by submitting your personal information for processing by our Services, you consent to the transfer of your personal information to and from the U.S. from and to other countries or regions in connection with storage and processing of personal information, fulfilling your requests, and operating the Services.
Your Privacy Rights and Choices #
Your Privacy Rights
- If you are a resident of any Applicable State, you may have rights to request access to specific information, data portability and deletion, as described below. These rights are not absolute, and in some instances, we may decline your request as permitted by law. Access. You have the right to request that we disclose to you the following information about how we have collected and used your personal information: (i) the categories of personal information collected about you, (ii) the categories of sources from which the personal information is collected, (iii) the business or commercial purpose for collecting, selling, or sharing personal information, (iv) the categories of third parties whom the business discloses personal information, (v) the categories of personal information that we disclosed for a business purpose, (vi) the categories of third parties to whom the personal information was disclosed for a business purpose, and (vii) copies of the specific pieces of personal information the business has collected about you.
- Correction. You have the right to request that Flexe correct inaccurate personal information collected from you, subject to certain exceptions allowed under applicable law. If we determine, based on the totality of the circumstances, that the information is not accurate, we will respond to the request by correcting the information, deleting the information (if deletion of the information does not negatively impact you), or providing you with the name of the source from which we have received the alleged inaccurate information (if we are not the source).
- Deletion. You can request that we delete your personal information that we maintain about you, subject to certain exceptions.
- Opt-out (Do Not Sell or Share My Personal Information). As described above in “Advertising and Analytics Services Provided by Others,” we allow our advertising partners to use cookies and other technologies to collect personal information about you in order to show you advertisements that are targeted to your interests. In order to opt out of disclosures to these third parties for targeted advertising, please opt out through the link “Do Not Sell or Share My Personal Information” which can be accessed at the bottom of the website https://www.flexe.com/.
- We also honor the Global Privacy Control, a browser-based opt-out signal to opt out of the sharing of information linked to your browser or device that you used to access our Services. Please be aware, however, that opt-out preference tools are limited to the browser or device you are using. Your browser may save some information in its cookies or cache to maintain your privacy preferences, and if you clear cookies, you may remove your opt-out preference and be required to opt out again.
- Right to be free from discrimination. You have the right not to be discriminated against for exercising these rights.
- Appeals. You have a right to appeal decisions concerning your ability to exercise your consumer rights by contacting us using the information provided in “Submitting your Requests” below.
Submitting your Requests
Residents of Applicable States may be entitled to request to exercise their rights as a consumer or a data subject up to twice in a 12-month period. We may charge a reasonable fee for excess requests in the same 12-month period, as permitted by applicable law. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. Employment-related information will not be included in fulfillment of your requests.
We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.
You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent identifies themselves as an authorized agent and can show written permission from you to represent you. We may contact you directly to confirm that you have authorized the agent to act on your behalf and confirm your identity. Separate from the rights listed above, California’s “Shine the Light” law permits California residents to request certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.
Additional Privacy Rights and Choices
Updating your Account Information
Your organization’s account administrator has the ability to make changes and updates to your profile information, and to deactivate the corporate account under which you use the Services. Note that we may retain certain personal information as required by law or for legitimate business purposes after an account has been closed. We may also retain cached or archived copies of information about you for a certain period of time.
Opt-out of Marketing Messages
You may opt out of receiving marketing emails from Flexe by following the unsubscribe instructions in those messages. If you opt out, you may still receive relationship e-mails from us, including emails about your account or our ongoing business relations, responses to e-mails that you sent to us prior to opting out, notices of updates or changes to our policies and procedures, or other messages relating to your use of the Services.
Your Responsibilities; Updating Personal Information
You acknowledge and agree that you, not Flexe, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all personal information that you submit, and for ensuring that any personal information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Services, the information you receive when using the Services, and our ability to contact you.
When you use our Services, we make a good faith effort to provide you with access to your personal information and to either correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes.
When We Act as a Service Provider #
When a customer uses our warehousing and fulfillment services, we may store or otherwise process personal information on behalf and under the instructions of our customers, which we process as a service provider on that customer’s behalf. We are not responsible for and have no control over the privacy and data security practices of such customers, which may differ from those explained in this Privacy Policy. The data protection rights listed above do not apply to Flexe where we process your data as a service provider on behalf of a customer. If your data has been submitted to us by or on behalf of a Flexe customer and you wish to exercise any rights you may have under applicable data protection laws, please contact them directly.
